1.     The website operating at www.tiross.com is operated by TIROSS POLSKA spółka z ograniczoną odpowiedzialnością entered in the Register of Entrepreneurs by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division of the National Court Register {KRS) under the KRS No.: 0000278511, share capital: PLN 400,000.00, place of business and service address: ul. Al. Krakowska 118, Sękocin Stary, 05-090 Raszyn, NIP [Tax Identification Number]: 5342351449, REGON [National Business Registry Number]: 140916851, electronic mail address (email): office@tiross.com, Telephone No.: +48 22 759 60 75.

2.     The www.tiross.com Website operates according to the rules set out in these Terms and Conditions.

3.     The Terms and Conditions specify the types and scope of services provided electronically by the www.tiross.com Website, the rules for the provision of these services, the terms and conditions for conclusion and termination of agreements on the provision of services electronically, as well as the complaint procedure.

4.     Each Service User is obliged to comply with the provisions of these Terms and Conditions as soon as they start using the Electronic Services of the www.tiross.com Website.

5.     In matters not covered by these Terms and Conditions, the provisions of the following acts shall apply:

5.1.                    Civil Code;

5.2.                    Act on Consumer Rights of 30 May 2014 (Journal of Laws 2014 item 827);

5.3.                    Act on Providing Services by Electronic Means of 18 July 2002 (Journal of Laws No. 144, item 1204 as amended) and other relevant provisions of Polish law.

1.     CONTACT FORM - a form available on the Website allowing the submission of an enquiry regarding products available in the catalogue at www.tiross.com

2.     TERMS AND CONDITIONS- these Terms And Conditions of the Website.

3.     WEBSITE / SERVICE– Service Provider's website operating at www. tiross.com

4.     SERVICE PROVIDER -TIROSS POLSKA spółka z ograniczoną odpowiedzialnością, KRS No.: 0000278511, share capital: PLN 400,000.00 place of business and service address: ul. Al. Krakowska 118 , Sękocin Stary, 05-090 Raszyn, NIP: 5342351449, REGON: 140916851.

5.     SERVICE USER - a natural person, legal person or organisational unit without legal personality, to whom the Act grants legal capacity, using an Electronic Service.

6.     ELECTRONIC SERVICE - a service provided electronically by the Service Provider to its User via the Website.

 

III.              TYPES AND SCOPE OF ELECTRONIC SERVICES

1.     The Service Provider enables the use of the Contact Form via the Website.

2.     The provision of Services to Service Users on the Website is subject to the conditions set out in the Terms and Conditions.

3.     The Service Provider is entitled to place advertising content on the Website. Such content constitutes an integral part of the Website and the materials presented therein.

 

IV.              TERMS AND CONDITIONS FOR THE CONCLUSION AND PERFORMANCE OF AGREEMENTSFOR ELECTRONIC SERVICES

1.  Provision of Electronic Services specified in Chapter III item 1 of the Terms and Conditions by the Service Provider is free of charge.

2.  The agreement for the provision of Electronic Services involving the use of the Contact Form is concluded for a definite period of time and terminates at the moment of discontinuation of the use of these Services by the Service User.

3.  Technical requirements necessary for cooperation with the ICT system used by the Service Provider:

a)     a computer with Internet access,

b)    access to email,

c)     web browser,

d)    enabling Cookies and Javascript in your browser.

4.  The Service Useris obliged to use the Website in a manner consistent with the law and good practice, with due regard for the personal rights and intellectual property rights of third parties.

5.  The Service User is obliged to enter factually correct data.

6.  The Service User is prohibited from providing unlawful content.

 

V.                COMPLAINT PROCEDURE

1.     Complaints related to the provision of Electronic Services by the Service Provider:

a)     Complaints related to the provision of Electronic Services via the Website may be made by the Service User via electronic mail to the following address: office@tiross.com

b)    In the above-mentioned e-mail message, please provide as much information and circumstances concerning the subject matter of the complaint as possible, in particular the type and date of occurrence of the irregularity and your contact details. The information provided will significantly facilitate and expedite consideration of the complaint by the Service Provider.

c)     The Service Provider shall consider the complaint immediately, no later than within 14 days.

d)    The Service Provider's response to the complaint shall be sent to the Service User's email address specified in the complaint or in any other way specified by the Service User.

 

VI.              INTELLECTUAL PROPERTY

1.     All content posted on the website at www.tiross.com enjoys copyright protection and is the property of TIROSS POLSKA spółka z ograniczoną odpowiedzialnością, KRS No.: 0000278511, share capital: 400,000.00PLN, place of business and service address: ul. Al. Krakowska 118, Sękocin Stary, 05-090 Raszyn, NIP: 5342351449, REGON: 140916851. The Service User shall be fully liable for any damage caused to the Service Provider resulting from the use of any content of the www.tiross.com website, without the consent of the Service Provider.

2.     Any use by anyone, without the express written consent of the Service Provider, of any of the elements comprising the content of www.tiross.com constitutes an infringement of copyright vested in the Service Provider and will result in civil and criminal liability.

 

VII.           FINAL PROVISIONS

1.     Agreements concluded through the Website are concluded in accordance with Polish law.

2.     Changes made by the Service Provider to the Terms and Conditions of the Website shall be binding on the Service User provided that the Service User has been correctly informed of the changes and has not terminated the agreement for provision of services by electronic means within 14 days of the Service User being informed of the changes by the Website.

3.     If any part of these Terms and Conditions is inconsistent with applicable law, the relevant provisions of Polish law shall apply instead of the challenged provision.

4.     Any disputes between the Service Provider and the Service User will be settled primarily through negotiations, with the intention of settling the dispute amicably. However, if this is not be possible or seems to be unsatisfactory for either party, the disputes will be settled by the competent common court.

5.     Judicial settlement of disputes:

a)     Any disputes arising between the Service Provider and a Service User who is also a Consumer shall be submitted to the competent courts in accordance with the provisions of the Civil Procedure Code of 17 November 1964. (Journal of Laws No. 43, item 296 as amended).

b)    Any disputes arising between the Service Provider and a Service User who is not a Consumer shall be submitted to the court having the jurisdiction over the seat of the Service Provider.

6.     A Service User who is a Consumer also has the right to use out-of-court dispute resolution methods, in particular by submitting, after the complaint procedure has been completed, an application for mediation or an application for the case to be examined by an arbitration court (the application form can be downloaded from the website: http://www.uokik.gov.pl/download.php?plik=6223). A consumer may also use the free assistance of a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection. Out-of-court settlement of claims after the complaint procedure has been completed is free of charge.
